Upcoming Changes to the Electronic Online System (EOS) 1. NEW FORMS TO BE RELEASED ON ePATENTS FROM 1 JULY 2004 Click here to view the notice in PDF ___________________________________________________________________ 2. Filing of Patents Form 26 With Patents Form 1 With effect from 1 July 2004, agents and applicants will be able to file a Patents Form 26 together with a Patents Form 1 via Online Internet Submission (OIS)/Online Attachment Preparation System (OAP) or Electronic Patent Preparation (EPP) as part of their filing requirements under rule 9(3)(a) of the Patents Rules. There is no need to wait for an application number to be sent by the Registry of Patents before agents and applicants can proceed to file Patents Form 26 using the Electronic Online System (EOS). ___________________________________________________________________ 3. Filing of Patents Form 1 Electronically Without An Abstract With effect from 1 July 2004, agents and applicants who do not have an abstract at hand at the point of filing a Patents Form 1 via OIS/OAP or EPP can still submit their applications without creating a page with the text "Abstract to be filed later" or "Abstract will not be filed" in the electronic file to be attached as the abstract. ___________________________________________________________________ 4. Attaching of Consolidated Specification With Patents Form 14 With effect from 1 July 2004, agents and applicants will be able to file a Patents Form 14 via OIS/OAP with a specification incorporating all amendments and corrections if the section on "History of replacement sheets filed" on the Patents Form 14 is not filled in. This is with regard to a PCT (National Phase) application where there had been amendments made to the description, claims or drawings at the PCT International Phase only. Agents and applicants thus have the option of submitting the said documents via OIS/OAP or EPP. ___________________________________________________________________ 5. Attaching of Cover Letter for Patents Form 13, Patents Form 17 and Patents Form 23 via OIS/OAP With effect from 1 July 2004, agents and applicants will be able to attach a cover letter as an optional attachment when filing Patents Form 13, Patents Form 17 and Patents Form 23 via OIS/OAP. ___________________________________________________________________ 6. Attaching of Supporting Document(s) for Patents Form 17 and Patents Form 23 via OIS/OAP and EPP With effect from 1 July 2004, agents and applicants will be able to attach supporting document(s) as optional attachment(s) when filing Patents Form 17 and Patents Form 23 via OIS/OAP and EPP. ___________________________________________________________________ 7. Changes to ‘Details of Request’ in Patents Form 23 With effect from 1 July 2004, in the manual Patents Form 23, sub-paragraph C for "Correction of an error in the Register or Patents Form" under paragraph 6 for "Details of Request" will be renamed to "Correction of an error in the Register", whereas sub-paragraph D for "Correction of Specification" is to be renamed to "Correction of errors in Patents and Applications". As such, a requested correction in relation to the correction of an error made in any Patents Form should be recorded under "Correction of errors in Patents and Applications". The changes in the manual Patents Form 23 will also be reflected in the Patents Form 23 on OIS and EPP. ___________________________________________________________________ 8. Filing of Patents Form 23 to Correct a Patents Form 23 via OIS With effect from 1 July 2004, agents and applicants will be able to file a Patents Form 23 to correct an earlier filed Patents Form 23 via OIS, under "Correction of errors in Patents and Applications". ___________________________________________________________________ 9. Filing of Patents Form 23 to Correct a Patents Form 14 allowable via OIS regardless of the Patent Status With effect from 1 July 2004, agents and applicants will be able to file a Patents Form 23 to correct a Patents Form 14 via OIS, regardless of the status of the patent i.e. whether the patent is already granted. ___________________________________________________________________ 10. Submission of Existing Patents Forms via Electronic Online System (EOS) With effect from 1 July 2004, the following Patents Forms will be made available for electronic submission via (i) OIS and (ii) OIS/OAP and EPP respectively: (i) PF9, PF11A, PF20, PF28, PF40, PF42; (ii) PF11B, PF12, PF17, PF19, PF24, PF37, PF46 ___________________________________________________________________ 11. Submission of New Patents Forms via Electronic Online System (EOS) With effect from 1 July 2004, the following Patents Forms will be made available via Electronic Online System (EOS), in accordance with the Round Table Amendments 2004. Agents and applicants will be able to submit PF1 (2004), PF13 and PF13A either via OIS or EPP, whereas PF10 (2004), PF11 (2004), PF11C (2004), PF45 (2004), PF45A (2004) and PF47 (2004) can be submitted electronically via OIS only. The usual Service Bureau charges will apply should these Patents Forms be submitted manually over the counter. PF11B (2004), PF12 (2004), PF14 (2004) and PF46 (2004), which have yet to be made available for electronic submission, will be accepted manually over the counter without any Service Bureau charges to be incurred. ___________________________________________________________________ 12. How to file a PF39 on paper and a PF41 electronically If you intend to file a PF41 as part of your filing requirements under the Patents Rules after filing a PF39 on paper, please note that you will not be able to file a PF41 electronically at the same time with a PF39 on paper. The Registrar will be treating this as a procedural irregularity under rule 100 of the Patents Rules, to be rectified accordingly. Having filed a PF39 on paper, please wait for an application number to be sent to you in writing. On receipt of the notification of the application number, please proceed to file a PF41 using the electronic online system, within one (1) month from the date of the notification from the Registry. ___________________________________________________________________ |
